Why would I use AcroCert instead of the local Council?

Unlike Council staff, our accredited certifiers must undergo a lengthy process to become accredited by the Building Professionals Board. To remain accredited each year, our staff must maintain a high level of competence and undergo regular training to ensure ongoing Continuing Professional Development.

What is included in AcroCert’s fee?

  • The appointment of AcroCert as the Principal Certifier.
  • Assessment and determination of an application for Complying Development Certificate, Construction Certificate and Occupation Certificate.
  • Conduct of nominated critical stage inspections.
  • The referral of complaints, or the investigation of complaints relating to the conduct of the development and the issuing of Written Direction Notices.
  • Issue of an Occupation Certificate, where requested within two years from the date of AcroCert’s approval.
  • The archiving and lodgement of all relevant statutory documents as prescribed by the legislation.

What other fees might I have to pay?

  • Additional fees apply for the issue of any modified approval.
  • Additional fees apply for any amended plans that require stamping by the local water supply authority.
  • You may also need to pay for any reports or additional information required by the relevant SEPP or the Council as a precondition to the issue of a Construction Certificate, Complying Development Certificate or Occupation Certificate, such as a Bushfire Assessment Report, Flood Report, Dilapidation Reports, Arborist/Landscaping Reports, Stormwater Drainage Plans, or Geotechnical Report.
  • Fees for any additional inspections resulting from non-compliance, amended reports, designs or documentation required by AcroCert (or any other authority) after the lodgement of an application.
  • If your development is not completed within two years from the date of AcroCert’s approval you will need to pay for a Final Inspection and Occupation Certificate.
  • Additional fees are also payable should a Partial, or additional Occupation Certificate/s be required.

What is a Complying Development Approval? 

Complying development is a fast-track approval process for straightforward residential, commercial and industrial development. Complying development generally includes larger building works than exempt development. For this reason, ‘sign off’ by a building professional (known as a certifying authority such as AcroCert Pty Ltd) is needed. Provided the proposal fully meets specific development standards, it can be determined by AcroCert without the need for a full development application.

Complying Development Certificates are generally only available for developments that are prescribed in NSW State Environmental Planning Policies (SEPP), such as the Exempt & Complying Development Codes 2008. These can include secondary dwellings, dwelling houses, patio covers, sheds, garages and swimming pools. The certificate certifies that a proposed development meets the complying development criteria and that building works carried out in accordance with approved plans and specifications will comply with the relevant SEPP and the NSW Environmental Planning & Assessment Regulation 2021, or the Environmental Planning & Assessment (Development Certification & Fire Safety) Regulation 2021.

How do I know if my proposal can be Complying Development? 

You can check on the NSW Planning Portal: Complying Development | Planning Portal - Department of Planning and Environment (nsw.gov.au) or submit an application to AcroCert and we will assess your proposal to determine if it can be approved as complying development (additional fees may apply if you utilise this service), please contact us for further advice in this regard.

What is the NSW Planning Portal?

The NSW Planning Portal is an online environment where community, industry and government can work together to better understand and meet their obligations under the Environmental Planning and Assessment Act 1979.

It hosts a range of digital planning services, mapping tools and reporting tools to assist everyone involved in a proposed development. 

The digital services accessed via dashboards:

  • improve application determination times,
  • increase transparency of the planning system
  • ensure greater accountability of all stakeholders.

Digital Planning Services - Set up under the Act, the NSW Planning Portal is also the legal repository for certain planning documents, such as Ministerial Orders.

The ePlanning Program is currently working with all NSW councils to encourage greater engagement with the services on the NSW Planning Portal.

What happens if my proposal is not Complying Development and I need a Development Approval (DA) from Council? 

You will need to complete an online Development Application form through the NSW Planning Portal.

You can complete this application yourself or seek assistance from a Town Planner, we recommend the services of Complete Planning Solutions (CPS) a boutique building design and town planning firm located in the Hunter Valley. Note: Council will often require additional information if your proposal is in a Bushfire zone, a Geotech zone or a Heritage zone. Council will generally require justification for projects which do not meet their recommended guidelines, for example large structures which exceed the size and height guidelines, and variations to building lines. AcroCert has no control over what additional information Council may request as Council policies vary considerably. Delays in providing requested information directly impact on the time taken to complete your approval. 

Once your Development Application has been approved AcroCert can issue a Construction Certificate to allow building works to commence.

What is the estimated cost of building works?
You are required to notify the consent and certifying authority of the estimated cost of all building works associated with the development, including any retaining wall works. It must be a realistic assessment of the cost of the works which includes materials and labor. An easy way for you to understand this requirement is to consider how much you would insure the proposal for when all works are completed. AcroCert and/or the Council may require the submission of builder’s quotes or other evidence to justify the cost of works where it is considered that an estimate does not reflect the true value of the work. The cost of building works will also determine what, if any, additional fees and levies may be applicable to your development, such as Home Owners Warranty Insurance, the requirement for an Owner Builder Permit, the payment of Long Service Levies or the payment of any Council Development Contributions.

Will I need an Owner-Builder Permit or Home Warranty Insurance?
If you are an Owner Builder
  • For works under $5000 no permit is required
  • For works $5000 and over you will need to provide a copy of your Owner Builder Permit from the Department of Fair Trading. See their website at www.fairtrading.nsw.gov.au
  • For works over $20,000 Home Warranty Insurance will be required to be provided by you to the purchaser if you sell the property within 6 years
If you use a licensed builder
  • and the value of the work is over $20,000 a copy of the Home Warranty Insurance from the builder must be provided.

When can I commence construction?
When your application is approved, AcroCert will notify you of any outstanding information required prior to the commencement of construction. This might include the details of your builder, a copy of your Home Warranty Insurance, a pre-commencement statement, and/or a waste management plan. 

Once all the requirements have been met AcroCert will provide you with a signed ‘Notice of Commencement’. This document MUST be emailed to your Local Council 48 hours prior to commencing works.

After this has been complete you can commence construction!

How do I organise inspections during the course of construction?
It is essential that you request an inspection for all mandatory critical stage inspections. These inspections will be noted in your approval paperwork.

Contact our office prior to 3:00pm on the day before you’d like your inspection. We aim to provide booked inspection times if necessary.
